Evans Monari was a partner and Head of Litigation and Dispute Resolution at Coulson Harney LLP, Advocates, a corporate law firm in Kenya. He is an advocate of the High Court of Kenya and was part of President Uhuru Kenyatta’s legal team at the Iinternational Criminal Court (ICC). He was admitted as a lawyer in 1987 after the completion of his studies at the University of Nairobi.

The Advocate handled high profile criminal briefs and represented various clients in public inquiries and inquests. He is credited for complex civil litigation having handled a myriad of commercial, civil, judicial review and constitutional briefs. He also handled high profile criminal briefs.

He defended several private public bodies in multi-jurisdictional disputes. “He is instructed in bespoke complex regional/ international commercial disputes and international arbitrations as well as matters involving public international law,” his biography states in part. He was also a chair of public listed companies as well as local and international charities.

He was among the defence team that represented President Kenyatta, former Police Commissioner Hussein Ali and former Head of Civil Service Francis Muthaura who were facing charges for crimes against humanity at the Hague-based International Criminal Court (ICC) arising from the 2007-08 post-election violence in Kenya.

Monari has been the co-vice chair of the International Bar Association Africa Forum, representing the Law Society on the Board of the Council for Law Reporting. He also was an Adjunct Professor of Law at the Kenya School of Law and a member of the East African Law Society.

Monari served in several public appointments among them the 2016 Independent Electoral and Boundaries Commission (IEBC) selection panel.

Monari had the dream of a political career in the future. He said in a past interview: “I am glad that at my age, I have achieved my goals in life. I have a passion for politics and therefore a political career might just be looming. I am certain that my legal expertise would come in handy at the Senate.”

Lawyer Evans Monari died on 4 October 2021 at the Nairobi Hospital where he was admitted following a long illness. He had been battling multiple complications in his internal organs and was admitted to the Intensive Care Unit (ICU), according to the family.

His brother Ken Monari announced his death in a statement posted to the social media account that was raising funds for his medical bills. Ken wrote: “It is with profound sadness that I would like to inform on behalf of the Ogeto family that Evans has gone to be with the Lord. May the almighty God rest his soul in peace. Thank you for your continued support.”

Hon. Justice Martha Koome, EBS Chief Justice & President of the Supreme Court of Kenya, said in the following statement: “It is with deep sadness that I join other Kenyans on my own behalf and the Judiciary, to mourn the untimely death of Advocate Evans Monari who passed away on the night of 4,” October, 2021 while undergoing treatment at the Nairobi Hospital.

“I have known Evans for the last 38 years since we met as first-year law students at the University of Nairobi.

“I lack appropriate words to describe how wonderful, conscientious, friendly and a caring person Evans was. He had that never-ending joy that was evident in his signature smile, with the potential of cheering everyone even at the lowest moments.

“He had a deep sense of humour that thawed every situation and broke all barriers. Yet in Evans, lay this gallant and astute lawyer who represented the high, mighty and even poor clients who consulted him with equal measure of care and professionalism.

“The legal profession has lost one of our best Advocates who contributed immensely by mentoring many upcoming lawyers and was a great role model.

“Very few people can navigate a balance of enjoying their full social life and professional calling like Evans did.

“My last interaction with Evans was in July this year when in his usual jovial manner, took the lead in organising a wonderful felicitation for me and other colleagues who were promoted to various positions in the Judiciary.

“For the School of Law Class of 87, we mourn Evans, our prefect and leader who sacrificed his time and other resources to ensure that we were fully coordinated to offer support to one another especially in times of bereavement and other upheavals.

“When we learnt of Evans’ hospitalisation, we were saddened and stood in prayer for him. We appreciate our days on Earth are numbered and it is God who gives us all the years we live.

“We will forever remember Evans as we continue to pray for his soul that the same energy, joy and vigour that pervaded his entire life will continue in Heaven.

“I pray that God Almighty comforts his dear family, relatives, friends and give them the fortitude to bear this great loss. Rest in Peace my friend Evans! Rest in power and never-ending Joy until we meet again.”
