He signed a contract with TNA Impact Wrestling after being fired by WWE in 2009 and became even more reliant on drugs. In September the same year, he was arrested on drug trafficking charges and pled guilty .After a year later, when he was sentenced to ten days in jail, 30 months of probation, and a fine of $100,000 she who convinced him to check into rehab to save their family.

Anthem claimed that the ‘Broken’ gimmick and the Hardy children were their property as “contractually anything created by contracted performers while in TNA is owned 100% by Anthem” including “intellectual property AND human beings”.
This caused a huge controversy, with legal experts opining that she might get half custody of their children as she was not under contract, while Jeff’s brother Matt and his wife wrestler Reby Sky, both signed to TNA at the time, might lose custody of their son Maxel. While the two brothers sought legal help, Beth and Ruby vehemently criticized Anthem on social media. Many fans and influential people from wrestling sided with the parents, which eventually forced Anthem to release the ownership of the gimmick and settle the issue in late 2017.
