Elizabeth Scherer is a judge of the Seventeenth Judicial Circuit Court in Broward County, Florida. She was appointed as a judge of the 17th Judicial Circuit Court in December 2012 by then-Gov. Rick Scott, a member of the Republican party, to replace retired Judge David Krathen. She has since been elected to the bench twice.
Before she became a judge in December 2012, Scherer had previously spent more than a decade as a prosecutor in the State Attorney’s Office, including six in the Career Criminal Trial Unit.
She’s an avowed equestrian, a doting mom and a former state-champion volleyball player, according to her Instagram account. She also serves on the boards of directors for both Voices For Children and St. Anthony Catholic School Friends For Education, according to her court bio. She is a volunteer faculty member at the school and was named a judicial advocate of the year in 2013.

Broward County Circuit Judge Elizabeth Scherer oversaw the penalty trial of Parkland school shooter Nikolas Cruz. He received a life sentence after a divided jury was unable to agree on the death penalty for the 2018 mass killing of 14 students and three staff members at Marjory Stoneman Douglas High School.
In 2018, Judge Scherer made headlines when she berated reporters from The South Florida Sun Sentinel for publishing information about Cruz’s therapeutic history. The details were in public records that had not been properly redacted by Broward County Public Schools.
Judge Scherer threatened to restrict future news reports, an unconstitutional practice known as a prior restraint, though she did not ultimately do so.

Circuit Judge Elizabeth Scherer is a member of a political family. She is the daughter of one of the most politically connected Republican fundraisers in South Florida. Her father, William R. Scherer, co-founder of the prestigious Conrad & Scherer law firm, was one of the attorneys working for George W. Bush on the presidential election recount of 2000. He was a longtime member of the county’s Judicial Nominating Commission and an adviser to Gov. Rick Scott.
Law is the Scherer’s family business. Her brothers, John and William III are also attorneys who work for their father’s Fort Lauderdale legal firm.
Speaking about the similarities in style she shares with her father during a 2000 interview with the Daily Business Review, Scherer said via The Palm Beach Post: “I think we have a lot of the same ways of putting the pieces of a puzzle together, so to speak, in a way that’s sort of hard to explain. When it clicks, it clicks.”

In May 2009 her former husband, Anthony Mercer, was arrested in Fort Lauderdale on numerous felony charges while allegedly in possession of one ounce of cocaine, a pound of marijuana and prescription pills.
Judge Scherer filed for divorce the next day, though her husband told police they had separated three months before that, according to the Sun Sentinel.
The charges against Mercer, who has a daughter with Scherer, were dropped in August 2009 by the Palm Beach County state attorney’s office, where the case was transferred.
