Scott McAfee is a Judge on the Fulton County Superior Court in Georgia. He was sworn in as Fulton County’s Superior Court Judge on February 1, 2023. The judge was appointed to the bench in December 2022 by Georgia Republican Gov. Brian Kemp, after serving as inspector general for the state from 2021 to 2023.

“Scott McAfee is a strong addition to my administration,” Kemp said in a statement at the time of McAfee’s 2021 appointment. “His experience as a tough prosecutor equips him to search out fraud, waste, abuse, and corruption, and bring those to justice who break the law.”

As Inspector General, McAfee was responsible for investigating allegations of fraud, waste, and abuse in the Executive Branch of state government.

Before accepting his position as Inspector General, McAfee spent his legal career in public service, working the last eight years as an Assistant United States Attorney for the Department of Justice in the Northern District of Georgia and as an Assistant District Attorney in Fulton County. As an AUSA, McAfee investigated and prosecuted major drug trafficking organizations, fraud, and illegal firearms possession. In the Fulton County District Attorney’s Office, McAfee handled hundreds of felony cases ranging from armed robbery to murder.

McAfee graduated from Emory University in 2010 with a degree in political science and music after attending the school on a scholarship to play cello in the school’s symphony orchestra, as per his biography. He later received his law degree from the University of Georgia in 2013. While in law school, McAfee was inducted into the Order of the Barristers. He has also previously worked for Justice David Nahmias and Justice Keith Blackwell of the Georgia Supreme Court.

In August 2023, McAfee was assigned to the Georgia case, as Fulton County District Attorney Fani Willis (D) unveiled a 98-page indictment charging Trump and 18 others on charges related to their efforts to overturn the 2020 Georgia election results. Trump alone faces 13 counts, ranging from issuing false statements and impersonating a public officer to conspiracy and racketeering.

In interviews with The Atlanta Journal-Constitution, McAfee’s friends and former colleagues described him as a bright and driven legal “star” with a mild-mannered demeanor, impeccable ethics and plenty of conservative credentials.

“He is probably the best person I can think of to handle this case fairly and efficiently,” said Alex Stewart, a longtime friend who competes on McAfee’s Atlanta Lawn Tennis Association team. “I have high hopes and feel good about his ability to be objective in this case as well and not fold to pressure from either side.”
